December 5, 2022 Opinion or Order TEXT Minute Entry for a stenographically-recorded telephonic Rule 16 conference held on 12/5/2022 before U.S. Magistrate Judge Andrew T. Baxter: The court explained to pro se plaintiff, at length, how the pretrial process in this case will proceed and the necessary steps for completing pretrial deadlines. The court noted some obvious deficiencies in plaintiffs complaint and the parties agreed that plaintiff would mail a draft amended complaint to defense counsel to determine whether it could be filed on consent without motion practice. Mandatory disclosures have been exchanged. The court explained the Assisted Mediation Program to the parties and deferred referring this case into that program given defense counsels view that a settlement conference would not be productive, at least before resolution of dispositive motions. Pretrial deadlines were established and a scheduling order will be issued on behalf of District Judge DAgostino. A follow-up telephonic conference is set for 1/31/2023 at 11:00 AM. Appearances: Michael S. Walker, pro se plaintiff and Thomas K. Murphy, Esq. for defendant. (Court Reporter: Ruth Lynch. Time: 10:01 AM 10: 46AM.)
