Filing 5 ORDER and REPORT-RECOMMENDATION: it is ORDERED, that plaintiff's application to proceed IFP (Dkt. #2 ) is GRANTED only for purposes of filing and any appeal, unless the trial court certifies in writing that the appeal is not taken in good faith, and it is RECOMMENDED, that the following claims in Case Nos. 5:22-CV-1102 and 5:22-CV-1164 be DISMISSED WITH PREJUDICE and it is RECOMMENDED, that the Syracuse Police Department and the Onondaga County District Attorneys Office be DISMISSED WITH PREJUDICE and it is RECOMMENDED, that the other claims and defendants in the complaints in Case Nos. 5:22-CV-1102 and 5:22-CV-1164 be DISMISSED WITHOUT PREJUDICE. Pursuant to 28 U.S.C. 636(b)(1) and Local Rule 72.1(c), the parties have fourteen (14) days within which to file written objections to the foregoing report.
