Filing 6 TEXT ORDER: The Court has reviewed Plaintiff's #5 Motion to Alter Judgment. The Court construes Plaintiff's motion a motion for reconsideration of its #4 Memorandum-Decision and Order denying Plaintiff's motion to proceed by pseudonym, ordering Plaintiff to file, within thirty days, a complaint naming the parties and providing Plaintiff's address, and advising Plaintiff that this case will be dismissed if Plaintiff fails to do so. In general, a motion for reconsideration may only be granted upon one of three grounds: (1) an intervening change of controlling law; (2) the availability of new evidence; or (3) the need to correct a clear error of law or prevent manifest injustice. United States v. Zhu, 41 F. Supp. 3d 341, 342 (S.D.N.Y. 2014) (citing Virgin Atl. Airways, Ltd. v. Nat'l Mediation Bd., 956 F.2d 1245, 1255 (2d Cir. 1992)). Plaintiff's #5 Motion is DENIED as it fails to identify a change of controlling law, new evidence, or a need to correct a clear error of law or prevent manifest injustice. If Plaintiff fails to file a complaint within thirty (30) days of the date of this Text Order disclosing Plaintiff's identity to the Court and providing an address, this case will be dismissed without further order. It is further ORDERED that as Plaintiff has failed to provide an address, the Clerk is directed to serve this Text Order, via email at the email address Plaintiff provided. Signed by Chief Judge Brenda K. Sannes on 09/01/2023. (sr) |
