ORDER TO SHOW CAUSE WHY CASE SHOULD NOT BE TRANSFERRED. This lawsuit was filed by Plaintiffs Kimberly Clark and Alexander Hagen (collectively Plaintiffs) citizens of Florida who previously resided in New York against Defendants Progress Software Corp. and Greater Rochester Independent Practice Assoc., Inc. (Defendant GRIPA). Defendant Progress Software Corp. is organized under the laws of the State of Delaware with its principal place of business in Burlington, Massachusetts. Defendant GRIPA is organized under the laws of the State of New York with its principal place of business in Rochester, New York. Although the Complaint alleges that Defendant GRIPA is based in this District (Dkt. No. 1 at 31), Rochester, New York is located within the geographical boundaries of the U.S. District Court for the Western District of New York (W.D.N.Y.). It is unclear to the Court why this case was not filed in the W.D.N.Y. Plaintiffs are directed to file a response to this order to show cause on or before December 1, 2023, stating whether there are proper grounds for this case to remain in the district court for the Northern District of New York and whether the Court should transfer this case to the W.D.N.Y. pursuant to 28 U.S.C. 1404(a).
