MEMORANDUM-DECISION AND ORDERED, that Defendants Motion to Dismiss (Dkt. No. 8) is GRANTED in part, as to the dismissal of Plaintiffs claims against the City of Albany and John Reilly, Plaintiffs false arrest claim against Michael Romano relating to the issuance of the tickets, and Plaintiffs malicious prosecution claim against Michael Romano, and DENIED in part, as to Plaintiffs false arrest claim against Michael Romano relating to the initiation of the stop; and it is further ORDERED, that the Clerk of the Court terminate the City of Albany and John Reilly as Defendants in this action.
