February 5, 2019 Opinion or Order Filing 14 TEXT ORDER: Court has reviewed letter from Plaintiff (Dkt. No. #13 ) requesting information about the Court's prior directive. (Dkt. No. 12 .) As the Court has previously stated in Dkt. Nos. #7 and 12 , Plaintiff MUST provide further information by 2/18/2019 regarding the "settlement check $65,000" referenced in paragraph 3(f) of his original in forma pauperis application. (Dkt. No. #4 .) Plaintiff should provide information in an affidavit or declaration regarding the date he received the settlement check, his present ability to use any money from the settlement check to pay the filing fee in this action, and any reason why he does not have the ability to use money from the settlement check to pay the filing fee in this action. The Court's directives are very clear as to what information is required from Plaintiff to properly evaluate his ability to pay the filing fee. If Plaintiff does not provide the required information by 2/18/2019, the application for in forma pauperis status will be denied and Plaintiff will be required to pay the filing fee. The Clerk is directed to forward another copy of Dkt. Nos. #4 and #7 , along with a copy of the docket, to Plaintiff with this Text Order. January 28, 2019 Opinion or Order Filing 12 TEXT ORDER: Court has reviewed Dkt. No. #11 . To support his motion to proceed in forma pauperis, Plaintiff must provide to the Court by 2/18/2019 an affidavit or declaration stating details of where the proceeds are located regarding the settlement check of $65,000 referenced in paragraph 3(f) of his original in forma pauperis application. (Dkt. No. #4 .) Plaintiff should also provide in the affidavit or declaration information regarding the date he received the settlement proceeds, his present ability to use the settlement proceeds, and any reason why he does not have any of the proceeds to pay for the filing fees in this action. If Plaintiff fails to provide the information about the settlement proceeds as directed by 2/18/2019, his application for in forma pauperis status will be denied and he will be required to pay the filing fee before any further action can be taken on the case. Plaintiff's case will not move forward until these issues are resolved. The Clerk is directed to send Plaintiff a copy of Docket No. 4 for his reference. No. #7 was returned as undeliverable, although it was sent to Plaintiff at the address the Court has on file for him. A review of DOCCS Inmate Lookup Website shows that Plaintiff is currently located at the Willard Drug Treatment Center. Therefore, the Clerk is directed to forward a copy of Dkt.
