TEXT ORDER directing the Clerks Office to close this action. Plaintiff has voluntarily discontinued this action without prejudice pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), requiring no Court Order of Dismissal. Plaintiff is advised that, because his pending motions to proceed IFP and to appoint counsel are moot, the Court will not be deciding them. Plaintiff is also advised that, because the Complaint's request for relief in the form of "[a]n immediate restraining Order" (Dkt. No. #1 , at 5-6) was unaccompanied by a motion in compliance with Fed. R. Civ. P. 65(b) and L.R. 7.1(f) and (b), that request too is moot and shall not be decided. SO ORDERED by Chief Judge Glenn T.
