Filing 7 TEXT ORDER: Denying #5 plaintiff's request to approve his method of attempted service because service of a complaint and summons by certified mail alone generally does not constitute adequate service. Some defendants may be willing to waive formal service on Form AO 399, which, after being completed by plaintiff, may be sent by regular mail on the defendants. The Clerk shall provide plaintiff with a blank copy of Form AO 399 in case he wishes to complete these forms and mail them to defendants to determine whether they will waive formal service based on the earlier transmission of the complaint and summons to them by certified mail. If the parties do not return an executed waiver form, the plaintiff must then attempt other means of adequate service. The Clerk is also directed to provide plaintiff with the contact information for the Pro Se Assistance Program so that he can inquire about the appropriate alternative ways in which to attempt service, if that proves to be necessary. If and when plaintiff obtains a waiver form from a defendant or has otherwise affected adequate service, he should file an acknowledgment of service with the Clerk along with a copy of the corresponding summons.
