TEXT ORDER: Letter Motion #14 is DENIED. The request to adjourn this matter into January of 2023 is denied. Counsel for Defendant seeks an adjournment stating that he has an appearance in state court on same date and time as this Rule 16 conference, that being 11/30/2022 at 10:00 a.m. The date and time of this Rule 16 conference, that being 11/30/2022 at 10:00 a.m., were set on 10/4/2022 (see Dkt. No. 2), more than 5 weeks ago and counsel had not previously expressed a conflict with any state court scheduling matter. If the state court matter was scheduled after this Court had already scheduled the Rule 16 conference in this case, then counsel can seek an adjournment in the state court matter. Additionally, counsel for Plaintiff has already failed to comply with three separate Court Orders issued by this Court. See Dkt. Nos. 9, 11, 12, & 13.
