DECISION AND ORDER granting in part and denying in part Defts' 49 Motion for Summary Judgment. The claims for false arrest and a violation of Pltf's due process rights are dismissed. Claims against the Village, David Whitton, and Gordon Ayens are dismissed. The motion is denied as to the claim for the use of excessive force against Deft Jason Whitton and the failure to intervene as to Young, which are the only remaining claims.
