Filing 10 Letter Motion from John D. Hoggan, Jr. for Leonard Knappmiller requesting Adjournment of Rule 16 Conference submitted to Judge Randolph F. Treece. (Hoggan, John) |
ORDER denying #10 , the parties' Letter Request, seeking a sixty-day adjournment of the Rule 16 Conference, which is scheduled for July 8, 2010, in order to pursue settlement. Although the Court applauds efforts to settle cases, we find that settlement negotiations can occur concurrently with the obligations to be contained in a Scheduling Order, without incurring greater cost. Moreover, there is no assurance that settlement will occur and we do not want to dissipate the time for this case to be trial ready. Under the civil justice act, a case is supposed to be trial ready within eighteen months. At least for these reasons, the Request is denied. SO ORDERED.. Signed by Magistrate Judge Randolph F. Treece on 6/17/2010. (Treece, Randolph) |
