August 30, 2012 Opinion or Order Text Only Order As an initial matter, Rivas' motion to appoint counsel is denied, (see Dkt. No. 83), as the court, in accordance with the Circuit's Mandate, already reappointed attorneys Kimberly Zimmer and Sally Wasserman to represent Rivas in this matter. Furthermore, in light of the respondent's intention to proceed in this court, (see Dkt. No. 86), the court agrees that a conference is necessary to expeditiously resolve this matter, (see Dkt. No. 85). To this end, a telephonic status conference will be conducted on Thursday, September 6, 2012 at 1:00 p.m. with counsel for the petitioner, attorneys Zimmer and Wasserman, and counsel for the respondent. Attorney Zimmer is directed to conference in all parties, and then initiate the call to chambers at (518) 257-1870.
