December 21, 2006 Opinion or Order Filing 9 DECISION and ORDER, that petitioner's8 Motion to Vacate is GRANTED; that the 7 Judgment of the Court entered herein on April 3, 2006 is vacated. The Clerk is directed to reopen this action and resetore same to this Court's docket; that Plaintiff's in forma pauperis application is granted. The Clerk shall issue summonses and forward them, along with copies of the Complaint, to the U.S. Marshal for service upon defendants. The clerk shall forward a copy of the summons and com plaint by mail to the Attorney General for the State of New York along with a copy of this order. The Clerk shall provide a copy of the plaintiff's inmate authorization form to the Superintendent of the facility and the Financial Deputy of the Clerk's Office. Defendants' response to plaintiff's complaint is to be filed as provided for in the FRCP. Plaintiff's motion for transfer to the Southern District of New York for joinder with Graziano v. Pataki is DENIED; all pl eadings, etc. to be filed in Syracuse with a certificate of service. Plaintiff is required to promptly notify the Clerk's Office and all parties or their counsel of any change in plaintiff's address; his failure to do so will result in the dismissal of this action.
