Pltf's 6th & 8th Amendment claims against defts Alexander and Fischer in their individual & official capacities and deft Pataki in his official capacity will be dismissed w/out prejudice, an d pltf's Due Process claims for immediate release against defts Alexander & Fischer in their individual & official capacities and deft Pataki in his official capacity will be dismissed w/out prejudice. Defts' motion to dismiss is denied in all other respects. Accordingly, IT IS ORDERED: 1) Defts Thompson, Clarke & Arena's motion to dismiss is GRANTED & are terminated as parties in this action. 2) Deft Pataki's motion to dismiss pltf's claims against him in his officia l capacity is GRANTED in accordance w/ this memorandum and DENIED in all other respects. 3) Defts Alexander & Fischer's motion to dismiss is GRANTED in accordance w/ this memorandum & DENIED in all other respects; Signed by Judge Lyle E.
