DECISION AND ORDER: Based upon a careful review of the entire file and the recommendations of the Magistrate Judge, the Report-Recommendation (Dkt. No. 51 ) is accepted in whole. See 28 U.S.C. § 636(b)(1). ORDERED that, Defendant D'Agos tino's motion for summary judgment (Dkt. No. 34 ) is GRANTED and all federal claims against him are DISMISSED. ORDERED, that defendant Masiello's motion for summary judgment (Dkt. No. 40 ) is GRANTED and all federal claims against her are DISMISSED. ORDERED, that to the extent plaintiff asserts state law claims, the exercise of supplemental jurisdiction will be declined pursuant to 28 U.S.C. § 1367(c)(3) and those claims are DISMISSED without prejudice. ORDERED, that the c omplaint is DISMISSED in its entirety. ORDERED, that the Clerk serve a copy of this Decision and Order upon plaintiff in accordance with the Local Rules, enter judgment accordingly, and close the file. Signed by Judge David N.
