Filing 7 DECISION AND ORDER: Plaintiff's IFP Application (Dkt. No. #5 ) is GRANTED. Plaintiff's Fourteenth Amendment Equal Protection claims are DISMISSED without prejudice in accordance with 28 U.S.C. 1915(e)(2)(B) and 28 U.S.C. 1915A(b) for failure to state a claim upon which relief may be granted. Plaintiff's Eighth Amendment failure-to-protect claims against defendants Snyder, John Doe #1, and John Doe #2 SURVIVE the Court's initial review pursuant to 28 U.S.C. 1915(e) and 28 U.S.C. 1915A and require a response. The Clerk shall issue a summons and forward it, along with a copy of the complaint, to the United States Marshal for service upon defendant Snyder. The Clerk shall forward a copy of the summons and complaint to the Office of the New York State Attorney General, together with a copy of this Decision and Order. A response to the complaint be filed by defendant Snyder, or his counsel, as provided for in the Federal Rules of Civil Procedure. Plaintiff must take reasonable steps to ascertain the identity of the "Doe" defendants, and when identified, seek to amend the complaint to add the individuals as defendants in this action pursuant to Federal Rule of Civil Procedure 15(a).
