Nos. #7 and #8 ), Plaintiff is advised as follows: (1) a summons was issued to the remaining defendant, Czerkies, on September 9, 2019 (see Dkt. No. 5); (2) Plaintiff is advised that within the time limits set forth in Rule 15(a) of the Federal Rules of Civil Procedure, Plaintiff may submit to the Court for review an amended complaint as of right or, if necessary, a motion to for permission amend his complaint supported by a proposed amended complaint; (3) any proposed amended complaint submitted must be a complete pleading which sets forth all of the claims Plaintiff seeks to assert in this action against the persons named as defendants; and (4) the Court cannot provide Plaintiff with legal advice. Filing 4 DECISION AND ORDER: ORDERED that #2 Motion for Leave to Proceed in forma pauperis is granted. ORDERED that Plaintiff's Eighth Amendment claims against Kaelin are DISMISSED without prejudice pursuant to 28 U.S.C. 1915(e)(2)(B) and 28 U.S.C. 1915A(b). ORDERED that Plaintiff's Eighth Amendment claims against Czerkies survive the Court's sua sponte review under 28 U.S.C. 1915(e)(2)(B) and 28 U.S.C. 1915A(b) and require a response. ORDERED that Kaelin is DISMISSED as a defendant herein. ORDERED that the Clerk shall issue a summons and forward it, along with a copy of the Complaint, to the United States Marshal for service upon the remaining defendant.
