February 27, 2020 Opinion or Order Filing 7 DECISION AND ORDER: It is ORDERED that Plaintiff's IFP Application (Dkt. No. #4 ) is GRANTED; The Clerk shall provide the superintendent of the prison facility in which plaintiff is currently confined with a copy of plaintiff's inmate authorization form (Dkt. No. #5 ), and notify the official that this action has been filed and that plaintiff is required to pay to the Northern District of New York the entire statutory filing fee of $350 in installments, over time, pursuant to 28 U.S.C. 1915; The Clerk shall provide a copy of plaintiff's inmate authorization form (Dkt. No. #5 ) to the Financial Deputy of the Clerk's Office; The Clerk shall attach the exhibits to the complaint (Dkt. Nos. #1 -1, #1 -2) as exhibits to the amended complaint; Plaintiff's First Amendment retaliation claim against defendant Bauersfeld survives sua sponte review and requires a response; Plaintiff's remaining Section 1983 claims are DISMISSED without prejudice pursuant to 28 U.S.C. 1915(e)(2)(B) and 28 U.S.C. 1915A(b) for failure to state a claim upon which relief may be granted; The Clerk shall issue a summons and forward it, along with a copy of the complaint, to the United States Marshal for service upon defendant Bauersfeld. The Clerk shall forward a copy of the summons and complaint by mail to the Office of the New York State Attorney General, together with a copy of this Decision and Order; A response to the complaint be filed by defendant Bauersfeld, or his counsel, as provided for in the Federal Rules of Civil Procedure.
