Filing 7 TEXT ORDER: The Court received a letter (Dkt. No. #6 ) from plaintiff on or about April 21, 2020, "seeking clarification" of the Court's Order dated April 14, 2020 (Dkt. No. #5 ("April Order")), which closed the action in light of plaintiff's failure to submit a completed and signed application to proceed in the action in forma pauperis or the full filing fee for commencing an action in this District. The Court's April Order provided plaintiff explicit instructions for complying with the filing fee requirements if he wished to pursue this action. See April Order at 4. For that reason, plaintiff's request for clarification is DENIED, and the Court will not restate those instructions in this Order. Out of special solicitude to plaintiff's pro se status, however, the Clerk is respectfully directed to serve on plaintiff a courtesy copy of the April Order, as well as a blank IFP application and inmate authorization form. Authorized by Judge David N. Hurd on 4/22/2020. (Copy served via regular mail, along with blank forms)(meb) |

No. #2 ) is DENIED as incomplete; and it is further ORDERED that Plaintiff's motion for the appointment of counsel (Dkt. No. #4 ) is DENIED without prejudice; and it is further ORDERED that because this action was not properly commenced, the Clerk is directed to administratively close this action; and it is further ORDERED that if plaintiff desires to pursue this action, he must, within 30 days of the filing date of this Order, (1) either (a) pay the $400.00 filing fee in full, or (b) submit a completed and signed IFP application; AND (2) submit a completed, unmodified, and signed inmate authorization form; and it is further ORDERED that upon plaintiff's compliance with this Order, the Clerk shall reopen this action and forward it to the Court for review; and it is further ORDERED that the Clerk shall serve a copy of this Order on plaintiff along with a blank IFP application and a blank inmate authorization form. Signed by Judge David N. Hurd on 4/14/2020. (Copy served via regular mail, along with blank forms)(meb) |
