No. 19, the Court notes the existence of factual disputes pertaining to the safety protocols at Adirondack Correctional Facility. See, e.g., Dkt. Nos. 19-1 11 ("Thus, there is simply no veracity to the plaintiffs' claims that staff are not screened before entering ACF, or before transferring inmates between facilities.") ; 19-4 13. "It is well established that 'the existence of factual disputes necessitates an evidentiary hearing... before a motion for preliminary injunction may be decided.'" Martinez-Brooks v. Easter, 459 F. Supp. 3d 411, 449-50 (D. Conn. 2020) (quoting Kern v. Clark, 331 F.3d 9, 12 (2d Cir. 2003)).
