Filing 4 DECISION AND ORDER: It is hereby ORDERED that plaintiff's IFP Application (Dkt. No. #2 ) is GRANTED; and it is further ORDERED that plaintiff's Fourteenth Amendment claims against defendants Saxe, Dill, Saxton, Provow, Nowicki, and McCulloch SURVIVE sua sponte review and require a response; and it is further ORDERED that plaintiff's Section 1983 claims for monetary relief against the named defendants in their official capacity are DISMISSED with prejudice pursuant to 28 U.S.C. 1915(e)(2)(B) as barred by the Eleventh Amendment; and it is further ORDERED that all remaining Section 1983 claims are DISMISSED without prejudice pursuant to 28 U.S.C. 1915(e)(2)(B) for failure to state a claim upon which relief may be granted; and it is further ORDERED that upon receipt from plaintiff of the documents required for service, the Clerk shall issue summonses and forward them, along with copies of the complaint, to the United States Marshal for service upon defendants Saxe, Dill, Saxton, Provow, Nowicki, and McCulloch. The Clerk shall forward a copy of the summons and complaint by mail to the Office of the New York State Attorney General, together with a copy of this Decision and Order; and it is further ORDERED that plaintiff's Motion for Counsel (Dkt. No. #3 ) is DENIED without prejudice as set forth above; and it is further ORDERED that the Clerk shall serve a copy of this Decision and Order on plaintiff. Signed by Chief Judge Glenn T.
