Filing 3 DECISION AND ORDER: It is hereby ORDERED, that Non-Signatory Plaintiffs Gleason, Lisk, Wagner, Perry, Applegate, and Smith are DISMISSED as parties to this proceeding based on their failure to sign the Complaint and comply with the filing fee requirements; and it is further ORDERED, that because this action was not properly commenced, the Clerk shall administratively close this action; and it is further ORDERED, that if Kurtz desires to pursue this action on behalf of himself only, he must, within thirty (30) days of the filing date of this Order, either (1) pay the $402.00 filing fee in full, or (2) submit a completed and signed IFP application; and it is further ORDERED, that if Kurtz pays the $402.00 filing fee in full, the Clerk shall reopen the action; and it is further ORDERED, that if Kurtz submits a completed and signed IFP application, the Clerk shall reopen the action and forward it to the Court for review; and it is further ORDERED, that the Clerk shall STRIKE the inmate authorization form filed by Kurtz, see Dkt. No. #2 ; and it is further ORDERED, that the Clerk shall serve a copy of this Order on Kurtz, along with a blank IFP application. The Court certifies that an in forma pauperis appeal of this Decision and Order would not be taken in good faith under 28 U.S.C. 1915(a)(3), and therefore, should Kurtz seek leave to appeal IFP, he is DENIED permission to do so.
