Filing 4 DECISION AND ORDER: ORDERED, that, because this action was not properly commenced, the Clerk of the Court is directed to administratively close this action. ORDERED, that Plaintiff's Letter Request for Appointment of Counsel (Dkt. No. #2 ) is DENIED without prejudice as moot in light of the closure of this action. ORDERED, that if Plaintiff desires to pursue this action, he must, within sixty (60) days of the filing date of this Order, either (1) pay the $402.00 filing fee in full; or (2) submit a completed and signed IFP application showing his post-release financial condition. ORDERED, that, upon Plaintiff's compliance with this Decision and Order, the Clerk shall reopen the action, including Plaintiff's Request for Appointment of Counsel (Dkt. No. #2 ), and forward it to the Court for review. ORDERED, that, in the event Plaintiff fails to timely comply with this Decision and Order, this action will be DISMISSED without prejudice without further Order of this Court. ORDERED, that, in accordance with Rule 10.1(c)(2) of the Court's Local Rules, Plaintiff shall promptly notify the Clerks Office and all parties or their counsel, in writing, of any change in his address; Plaintiff's failure to do so may result in the dismissal of this action. ORDERED, that the Clerk shall serve this Decision and Order on Plaintiff by mail at the address provided in the Notice of Address Change (Dkt. No. #3 ).
