January 30, 2024 Opinion or Order Filing 14 TEXT ORDER: Since the Court's issuance of the Decision and Order entered on January 17, 2024, plaintiff has filed two letters. Dkt. Nos. #12 , #13 . The first letter seeks judicial relief based on an incident that occurred after the filing date of the complaint. Dkt. No. #12 . The second letter includes additional allegations of wrongdoing related to plaintiff's claims that survived sua sponte review, as well as allegations related to the event described in the first letter. Dkt. No. #13 . The first letter was not filed as a proper motion and is not supported by any record evidence. For these reasons, insofar as the letter may be construed as a request for injunctive relief, it is denied without prejudice to him filing a proper motion, with supporting record evidence. See N.D.N.Y. L.R. 7.1; 65.1. Moreover, the Court does not construe either the first letter or the second letter as an amended complaint because neither is captioned as such or constitutes a complete pleading. Indeed, neither letter includes any allegations of wrongdoing by two of the defendants who remain in this case Millington and Rockwell. In the event plaintiff wishes to amend his complaint, he is advised that any amended complaint must bear his original signature, and must be a complete pleading, which will supersede and replace the original complaint in its entirety. The Clerk is directed to send plaintiff a copy of his original complaint #1 , his two recent letter submissions #12 , #13 , and a blank form complaint for his use in preparing an amended complaint if he so desires. ORDERED that the following claims SURVIVE sua sponte review: (1) plaintiff's Eighth Amendment excessive force claims against defendants Giordano, Millington, Rockwell, and Vitale; (2) plaintiff's First Amendment retaliation claim against defendant Giordano; and (3) plaintiff's Eighth Amendment medical indifference claims against defendants Giordano, Millington, Rockwell, and Vitale. ORDERED that plaintiff's Motion for Counsel (Dkt. No. #8 ) is DENIED without prejudice. ORDERED that upon receipt from plaintiff of the documents required for service, the Clerk shall issue summonses and forward them, along with copies of the complaint, to the United States Marshal for service upon defendants Giordano, Millington, Rockwell, and Vitale. The Clerk shall forward a copy of the summons and complaint by electronic mail to the Office of the New York State Attorney General, together with a copy of this Decision and Order.
