MEMORANDUM ORDER: After considering the issue, the Court concludes that it does not have jurisdiction. The Court grants petitioners latter request and orders that his removal be stayed for three (3) days, i.e., until 5:00 p.m. on February 13, 2009, so that he can seek relief from the Court of Appeals.
