Filing 34 OPINION & ORDER re: 28 MOTION to Reopen Case. filed by Kevin Razzoli, 29 APPLICATION to Appoint Counsel pursuant to 18 U.S.C. 3006(A)(g) (Habeas Corpus Petition). filed by Kevin Razzoli. For the foregoing reasons, Petitioners motion for reconsid eration and his request for a hearing and court-appointed counsel are denied. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). (Signed by Judge Kimba M. Wood on 10/25/2011) (djc) |
Filing 19 OPINION AND ORDER: The petition for habeas corpus is denied. Petitioners motion and supplemental motion for injunctive relief (Dkt. Nos. 4, 5) and various other letter requests are denied as moot. Petitioners remaining and largely incomprehensible cl aims, concerning inter alia the Governments alleged use of thermal gamma imagery to sterilize Petitioner, are dismissed as frivolous. See Razzoli v. Executive Office of the President, 08 Civ. 0139 (UNA), Dkt. No. 4 (Memorandum Opinion, dated March 5, 2008 at 1-2) (dismissing as frivolous Razzolis claims that federal government subjected him to electronic devices causing, in Petitioner's words, "loss of hair on legs, loss of er[]ection"). The Clerk of the Court is directed to close this case; any pending motions are moot. (Signed by Judge Kimba M. Wood on 4/9/2010) (jpo) |
