ORDER: Having conducted the appropriate level of review of the Report and Recommendation of United States Magistrate Judge Gabriel W. Gorenstein dated December 28, 2010, this Court APPROVES, ADOPTS, and RATIFIES the Report in its entirety. Accordingl y, Defendants' Motion to Dismiss is GRANTED in its entirety, and Plaintiff's Complaint is dismissed with prejudice and on the merits. Because the Court finds that amendment would be futile, permission to file an amended complaint is DENIED. The Court certifies pursuant to 28 U.S.C. § 1915(a) (3) that any appeal from this order would not be taken in good faith. See Coppedge v.United States, 369 U.S. 438, 8 L. Ed. 2d 21, 82 S.
