July 5, 2011 Opinion or Order Filing 13 MEMORANDUM & ORDER re: 11 Report and Recommendation. For the reasons set forth on this Order, the Court adopts the R&R in its entirety, overrules Petitioner's objections, and DENIED Burgess's Petition for a Writ of Habeas Corpus. Because Petitioner has not made a substantial showing of the denial of a constitutional right, a certificate of appealability will not issue. Pursuant to 28 USC § 1915(a)(3), any appeal taken from this order would not be taken in good faith. The Clerk of the Court is directed to close this case. (Signed by Judge Barbara S.
