Filing 59 OPINION AND ORDER ADOPTING REPORT AND RECOMMENDATION re: 40 FIRST MOTION for Summary Judgment filed by E. Maldonado, R. Dean, C. Bristow, E. Ramos. For the foregoing reasons, the Court adopts the Report in its entirety, and HEREBY ORDERS THA T Defendants' motion for summary judgment is GRANTED. Additionally, for the reasons set forth above, the Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith. Accordingly, IT IS FURTHER ORDERED THAT in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962).
