OPINION & ORDER re: 12 MOTION to Dismiss Notice of Defendants' Motion to Dismiss the Complaint for Failure to Make a Pre-Litigation Demand filed by Douglas L. Braunstein, William C. Weldon, David M. Cote, Ellen V. Futter, Lee R. Raymond, William H. Gray, III, James S. Crown, Laban P. Jackson, Jr., James A. Bell, David C. Novak, Michael J. Cavanagh, James Dimon, Stephen B. Burke, JPMorgan Chase & Co., Crandall C. Bowles, Ina R. Drew: Accordingly, Plaintiff has failed to plead particularized facts that create a reasonable doubt that a majority of the Board could have exercised disinterested and independent business judgment in considering demand, and Plaintiff's failure to make demand is not excused. The Court therefore GRANTS Defendants' motion to dismiss the Complaint. The Clerk of Court is directed to enter judgment and close this case. (Signed by Judge Paul A. Crotty on 7/16/2014) (tn)
