OPINION & ORDER re: 27 MOTION to Dismiss Under Fed. R. Civ. P. 12(b)(6) filed by City of New York, Michael Marchman. The Court GRANTS Defendants' motion to dismiss. Mr. Hicks' conviction was not obtained by any viol ations of the Constitution or laws of the United States. The Clerk is directed to enter judgment dismissing Plaintiffs' Complaint.
