Filing 116 OPINION AND ORDER: re: 86 MOTION for Summary Judgment filed by Derek Lynton, Felix Ramos, City Of New York, Daniel Robles, Richard Gibson, Ray Valeria, Robert Henn, Anthony D'Amato, 107 FIRST LETTER MOTION for Extension of Time of a ny New deadlines or Proceedings for Sixty (60) Days addressed to Judge Valerie E. Caproni from Ellie Silverman, Esq. dated September 14, 2018. filed by Freddie McGrier. For all the foregoing reasons, Defendants' motion for summary judgment is GRANTED. All of Plaintiff's claims are DISMISSED, with the exception of his claim against the City of New York for negligence arising out of the October 12, 2013 slip-and-fall incident and his claims against the City of New York for excessive fo rce and failure to intervene arising out of the July 15, 2013 cell extraction. No later than March 22, 2019, Plaintiff must show cause why those claims should not be dismissed. Defendants may respond no later than March 29, 2019. There will be no rep ly. The parties submissions must be in letter format and may not exceed five pages. If Plaintiff fails to show timely cause, these claims will be dismissed, and this action will be closed. The Clerk of Court is respectfully directed to CLOSE the open motions at Dkts. 86 and 107. SO ORDERED., ( Show Cause Response due by 3/29/2019.) (Signed by Judge Valerie E.
