Filing 30 OPINION AND ORDER re: 19 MOTION to Dismiss . filed by Walgreen Co., Duane Reade Inc. For the reasons above, Defendants' motion to dismiss is GRANTED. Plaintiff's Title VII claims are dismissed with prejudice as untimely . Plaintiff's NYCHRL claims are dismissed without prejudice for lack of jurisdiction. Plaintiff's Section 1981 claim is dismissed without prejudice, with Plaintiff granted leave to amend. Plaintiff is hereby ORDERED to provide a letter to the Court on or before March 1, 2019, stating whether he intends to file an amended complaint.
