Filing 4 ORDER OF DISMISSAL: Plaintiff, currently incarcerated in Attica Correctional Facility, submitted a request to proceed in forma pauperis (IFP application) and a prisoner authorization form. But Plaintiff failed to submit a complaint, which is required to commence a civil action in this Court. See Fed. R. Civ. P. 3. By order dated January 22, 2019, the Court directed Plaintiff to file a complaint within thirty days. That order specified that failure to comply would result in dismissal of the action. Plaintiff has not filed a complaint. Accordingly, the Court dismisses this action without prejudice. The Clerk of Court is directed to mail a copy of this order to Plaintiff and note service on the docket. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). Filing 3 ORDER DIRECTING COMPLAINT: It appears that Plaintiff, who is currently incarcerated at Attica Correctional Facility, purports to bring an action pro se. Plaintiff submitted a request to proceed in forma pauperis (IFP application) and a prisoner authorization form. But Plaintiff failed to submit a complaint, which is required to commence a civil action in this Court. See Fed. R. Civ. P. 3. Plaintiff is therefore directed, if he wishes to proceed with a civil action in this Court, to submit a complaint with an original signature to the Court within thirty days of the date of this order. The Clerk of Court is directed to assign this matter to my docket, mail a copy of this order to Plaintiff, and note service on the docket. No summons shall issue at this time. If Plaintiff complies with this order, the case shall be processed in accordance with the procedures of the Clerks Office. If Plaintiff fails to comply with this order within the time allowed, the action will be dismissed. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 44445 (1962) (holding that appellant demonstrates good faith when seeking review of a nonfrivolous issue).
