May 3, 2019 Opinion or Order Filing 11 STIPULATION AND ORDER OF SETTLEMENT: IT IS STIPULATED AND AGREED, by and between the Parties, through their respective counsel, as follows: This action is dismissed with prejudice and without costs, expenses, or attorney's fees. In lieu of Plaintiff's temporary six-month disqualification from SNAP, Plaintiff agrees to pay FNS a civil money penalty totaling $1,986.00, payable within 60 days of the date that Plaintiff signs this Stipulation. Plaintiff's payments shall be made by certified check or money order, made payable to the United States Treasury, and shall be delivered by certified or registered mail to the United States Attorney's Office, Financial Litigation Unit, 86 Chambers Street, 3rd Floor, New York, New York 10007. The checks shall identify in the "memo" section the case name and docket number. This Court shall retain jurisdiction over this action to enforce this Stipulation. (As further set forth in this stipulation) Any pending motions are moot. All conferences are vacated. The Clerk of Court is directed to close the case. SO ORDERED. (Signed by Judge Jesse M. See, e.g., Docket No. 1, 1. As set forth on the record on March 7, 2019, the application for a stay of the disqualification is GRANTED on the consent of Defendants. The disqualification shall be stayed for the duration of the proceedings in this case. Additionally, by March 21, 2019, Defendants shall submit a letter on behalf of both sides about how to proceed with this case.
