Filing 2 ORDER OF DISMISSAL: Plaintiff, currently incarcerated in the Sing Sing Correctional Facility, brings this pro se action. For the following reasons, the Court dismisses this action without prejudice. Plaintiff has previously submitted to this Court an identical complaint in which he names the same defendants and asserts the same claims. That action is pending before the Court. See Keesh v. Quick, ECF 1:19-CV-8942. Because the present complaint raises the same claims, no useful purpose would be served by litigating this duplicative lawsuit. The Court therefore dismisses this action without prejudice to Plaintiff's pending action in Keesh, ECF 1:19-CV-8942. The Court directs the Clerk of Court to assign this matter to my docket, mail a copy of this order to Plaintiff, and note service on the docket. The Court dismisses this action without prejudice as duplicative. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
