Filing 4 ORDER denying #3 Motion for Extension of Time. On November 19, 2019, the Court directed Plaintiff, within 30 days, to either pay the $400.00 in filing fees or submit an in forma pauperis ("IFP") application. On December 19, 2019, the Court received from Plaintiff a motion requesting an extension of 90 days to pay the filing fees, or alternatively, permission to make monthly payments of $50.00. (ECF No. 3.) The Court denies Plaintiff's requests for an extension of time to pay the $400.00 in fees or permission to make monthly payments. There is no need for the Court to delay this case so that Plaintiff can amass sufficient funds to pay the fees or to accept piecemeal payments. If Plaintiff is unable to pay the filing fees at this time, as stated in the November 19, 2019 order, he may submit an IFP application. Therefore, the Court directs Plaintiff to pay the $400.00 in fees or submit an IFP application within 15 days of the date of this order. If Plaintiff complies with this order, the case shall be processed in accordance with the procedures of the Clerk's Office. If Plaintiff fails to comply with this order within the time allowed, the action will be dismissed. The Clerk of Court is directed to mail a copy of this order to Plaintiff and note service on the docket. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be take in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue).
