October 16, 2023 Opinion or Order Filing 2 ORDER: Movant's motion under 28 U.S.C. 2255 is dismissed without prejudice because a Section 2255 motion is not the proper vehicle for seeking relief from state court criminal proceedings. The Court declines to recharacterize this Section 2255 motion as a habeas petition because, on the same day that he filed this motion, Movant filed two habeas petitions challenging the same state court proceedings. Because Movant has not at this time made a substantial showing of the denial of a constitutional right, a certificate of appealability will not issue. See 28 U.S.C. 2253. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
