July 27, 2020 Opinion or Order Filing 41 OPINION AND ORDER re: 20 MOTION for Sanctions: The motion to hold both defendants in civil contempt and for sanctions against defendant Wilton Calderon is GRANTED. Defendants are in contempt of the Judgment. It is hereby ORDERED that Wilton Cal deron is prohibited from operating Jiffy Station. Further, for a period of five years from the date of this Opinion and Order (i.e., today, through and including July 27, 2025), Wilton Calderon is prohibited from occupying any position within any bus iness for which he would be responsible for collecting, truthfully accounting for, paying, withholding, or filing, any taxes pursuant to the Internal Revenue Code, including, but not limited to, employment taxes. Should defendants satisfy their obligations set forth in the Judgment, these sanctions shall be lifted following an appropriate application to the Court. December 4, 2019 Opinion or Order Filing 29 ORDER: It is HEREBY ORDERED: 1. By December 23, 2019, plaintiff shall serve Calderon with a copy of this Order, its motion for contempt and sanctions, and a copy of Local Civil Rule 83.6, pursuant to Local Civil Rule 83.6 and Rule 4, and f ile proof of service of same. Proper service on Calderon shall be deemed sufficient service on Jiffy Cleaners pursuant to Rule 4(h)(1)(B). 2. Defendants' opposition to the instant motion shall be due 21 days after service is made. 3. Plaintiff's reply, if any, shall be due 7 days after defendants' opposition is filed.
