June 14, 2019 Opinion or Order Filing 91 OPINION & ORDER re: 71 MOTION to Dismiss the Second Amended Complaint. filed by CPL Calangelo, Captain Smith, Deputy Gurrieri, 80 MOTION to Dismiss Second Amended Complaint. filed by J. Fries, Deputy Montiferi, Pugh, M. Washburn, M. Shaw, Deputy Shaw., For the foregoing reasons, Defendants' motions to dismiss the SAC are GRANTED. Plaintiff shall have until July 15, 2019 to amend his SAC in accordance with this Opinion. No additional amendments will be granted thereafter. If Plaintiff elects to file a Third Amended Complaint, Defendants shall have until twenty-one days from the date of Plaintiff's filing to move or file responsive pleadings. Plaintiff is advised that any amended pleading is separate from the initial Complaint and any prior Amended Complaint and should include all facts and claims Plaintiff intends to assert. If Plaintiff does not amend his pleading by the aforementioned date, the entirety of this action, including Pl aintiff's state law claims, will be dismissed. If Plaintiff elects to file a Third Amended Complaint, Defendants are directed to answer or otherwise respond on or before August 14, 2019. The Clerk of the Court is respectfully directed to term inate the motions at ECF Nos. 71 and 80, mail a copy of this order to the Plaintiff, and file proof of service on the docket.
