Petitioner filed this action seeking relief under 42 U.S.C. 1983 and a Motion for leave to proceed in forma pauperis. The Court denied the Motion without prejudice, #3 , and administratively closed this matter with the right to reopen within 30 days upon the filing of a Motion that complies with the requirements of 28 U.S.C. 1915(a)-(b). Plaintiff has not yet sought to reopen this action and this action remains closed. Upon Plaintiffs filing of a motion to proceed in forma pauperis that complies with 28 U.S.C. 1915(a)-(b) and the reopening of this action, Plaintiff may refile the motion for appointment of counsel.
