Filing 38 ORDER granting 28 Motion for Partial Summary Judgment as to Plaintiff's Second and Sixth Claims for Relief and adopting 37 Memorandum and Recommendations - Per the court's April 16, 2018, order, the de adline to complete a mediation in this matter now is set 30 days from the date of this order. In the event claims remain for trial following mediation, the parties shall jointly file, within 45 days of the date of this order, a joint status report in forming of 1) estimated trial length; 2) particular pretrial issues which may require court intervention in advance of trial, if any; and 3) at least three suggested alternative trial dates.
