Filing 4 ORDER AND MEMORANDUM AND RECOMMENDATION regarding #1 MOTION for Leave to Proceed in forma pauperis. The court will grant Hopkins's IFP request, but recommends that Hopkins's Complaint be dismissed because it cannot clear the bar set out in Heck v. Humphrey . Thus, while the court grants her motion to proceed IFP, the District Court should dismiss the Complaint for failure to state a claim upon which relief may be granted. The Clerk of Court must serve a copy of this Memorandum and Recommendation (M&R) on each party who has appeared in this action.
