Filing 99 JUDGMENT - IT IS ORDERED, ADJUDGED AND DECREED that, pursuant to the court's order entered 9/23/2014 [DE-95], Plaintiffs' objection that Defendant's Motion for Bill of Costs [DE-92] was untimely filed is granted as to the district cou rt costs and Plaintiffs' objection that an award of costs is manifestly unjust is denied as moot. A review of Defendant's bill of costs fails to show sufficient information that Defendant incurred any costs under Fed.R.App.P.39(e) and any s uch costs are denied without prejudice. All other costs are waived under Local Civil Rule 54.1(a)(3) and Fed.R.App.P.39(d). IT IS FURTHER ORDERED, ADJUDGED AND DECREED that, pursuant to the court's order entered 9/17/2015 [DE-98], Plaintiffs 39; objection to the Defendant's Supplemental Motion for Bill of Costs [DE-96] is granted. Defendant's request for costs under Fed. R. App. P. 39(e) is disallowed. Signed by Deputy Clerk Jacqueline B. Grady on behalf of Julie Richards Johnston, Clerk of Court on 10/2/2015. (Grady, B.) |
Filing 98 ORDER denying 96 Motion for Bill of Costs - As plaintiffs correctly observe, none of the costs listed by defendant in the supplemental request [D.E. 96] are recoverable under Rule 39(e). Plaintiffs' objection is granted. Defendant's request for costs under Fed. R. App. P. 39(e) is disallowed. Signed by Julie Richards Johnston, Clerk of Court, on 9/17/2015. (Grady, B.) |
Filing 95 ORDER denying 92 Motion for Bill of Costs. Defendant may file a properly supported supplemental request for costs under Fed.R.App.P.39(e) within 14 days of this order, and a failure to do so will constitute a waiver of such costs. All other costs are waived under Local Civil Rule 54.1(a)(3) and Fed.R.App.P.39(d). Signed by Julie A. Richards, Clerk of Court, on 9/23/2014. (Grady, B.) |
