ORDER - Plaintiff's motion to strike or for sanctions 53 is DENIED. Defendants' motion for partial summary judgment 54 is GRANTED IN PART and DENIED IN PART as set forth herein. Plaintiff's claims for neglig ence, assault, and battery, may proceed against all defendants except for defendant SP Futures. Plaintiffs claim for negligent hiring, retention, and supervision, and all claims against defendant SP Futures are DISMISSED WITH PREJUDICE. Plaintiff 9;s motion to voluntarily dismiss 66 is DENIED AS MOOT.
