ORDER - This matter is before the court on plaintiff's pro se motion to obtain electronic case filing rights DE #2 . Also pending are plaintiffs notice of dismissal DE #6 and the court's October 2, 2023, notice of deficiency regarding the same. Where plaintiff has filed a notice of voluntary dismissal prior to any answer to the complaint, such notice serves to dismiss this action without further order of the court. See Fed. R. Civ. P. 41(a)(1)(A)(i). In addition, in light of plaintiff's filing of the notice of voluntary dismissal, the court DIRECTS the clerk to terminate as moot the instant motion to obtain electronic case filing rights, and the court terminates as moot the clerk's notice of deficiency raising an issue with plaintiff's signature.
