ORDER: Petitioner's motion for evaluation (DE 1) is GRANTED. Qualified evaluator employed at the Federal Medical Center in Butner, North Carolina may conduct an evaluation of respondent pursuant to 18 U.S.C. 4246(b) and 4247(b). Respondent having demonstrated eligibility for appointment of counsel at government expense, the Federal Public Defender is DIRECTED to provide representation in this action. The court further ORDERS appointment of an additional mental health examiner, pursuant to 18 U.S.C. 4247(b), to be selected by respondent. Respondent is DIRECTED to file notice providing the name of his additional mental health examiner within five days of entry of this order. The additional mental health examiner's report shall be filed on the docket and served on petitioner within 60 days of entry of this order. Within 60 days of entry of this order, the parties are DIRECTED to file joint notice of proposed hearing dates on which counsel and all witnesses can be available. Finally, petitioner moves to file forensic reports under seal (DE 4). The motion is GRANTED for the reasons set forth therein. Signed by District Judge Louise Wood Flanagan on 6/6/2023.
