March 15, 2024 Opinion or Order Filing 9 ORDER REOPENING CASE. The court, in its discretion, DEEMS plaintiff's March 11, 2024, filings a timely response to the order of deficiency and DIRECTS the clerk to re-open the case. Plaintiff's March 11, 2024, amended complaint, however, is not wholly on the forms prescribed for use by the court. See [D.E. 6]. Accordingly, the court DIRECTS the clerk to resend plaintiff the forms prescribed for use by the court for filing a 1983 complaint and further DIRECTS plaintiff to refile his complaint wholly on the correct forms by April 10, 2024. Any amended complaint will be subject to initial review, see 28 U.S.C. 1915(e)(2)(B), and the court will determine whether severance is appropriate, see Fed. R. Civ. P. 18(a), 20(a)(2). Finally, the court WARNS plaintiff that, if he fails to comply with this order in the time provided, the court will dismiss the action without prejudice for failure to prosecute.
