TEXT ORDER - This matter is before the court of its own initiative upon review of the record in this matter, which record reflects three foreign defendants have not been served or entered an appearance. Plaintiffs are DIRECTED to report on the docket within 14 days the status of service upon defendants Joyo Technology Co., LTD; Shenzhen Joyo Technology Co.; and Miaoyan Trading Co. LTD., and to propose a deadline by which plaintiffs reasonably and diligently will effect service. See Fed. R. Civ. P. 4(m) ("If a defendant is not served within 90 days after the complaint is filed, the courton motion or on its own after notice to the plaintiffmust dismiss the action without prejudice against that defendant or order that service be made within a specified time.... This subdivision (m) does not apply to service in a foreign country[.]"); Fed. R. Civ. P. 4(f)(1) ("Unless federal law provides otherwise, an individual... may be served at a place not within any judicial district of the United States... by any internationally agreed means of service that is reasonably calculated to give notice, such as those authorized by the Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents."); Volkswagenwerk Aktiengesellschaft v. Schlunk, 486 U.S. 694, 705 (1988) ("[C]ompliance with the Convention is mandatory in all cases to which it applies.").
