FURTHER that Barnes's motion for the appointment of substitute counsel (Docs. 59 , 60 ) be DENIED. For the reasons noted, the court will grant a certificate of appealability on the issue of whether the extraneous communication between Juror Jordan and Pastor Lomax had a "substantial and injurious effect or influence in determining the jury's verdict," or rather was harmless. See 28 U.S.C. § 2253(c)(2). A Judgment will be entered contemporaneously with this Memorandum Opinion and Order. (Daniel, J) |
